Welcome to Ponoki. These Terms of Service govern your use of the Ponoki website, web application, and mobile applications operated by Concept Allies and Yogesh Jain. By accessing or playing Ponoki, you agree to these terms.
1. Eligibility & Age Restriction (18+)
Ponoki is designed and offered exclusively for adults aged 18 years or older. By using the application, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into these Terms.
2. Clinical Disclaimer (Not Medical Advice)
Ponoki is an interactive self-help and relaxation tool, NOT a medical device or healthcare provider.
The breathwork games, cognitive reframing exercises, and audio soundscapes provided within Ponoki are designed for general relaxation and stress reduction. They do not constitute professional psychological therapy, psychiatric diagnosis, or medical treatment. Never disregard professional medical advice or delay seeking treatment because of anything you have read or experienced in Ponoki. If you are experiencing a mental health crisis, please contact local emergency services immediately.
3. License & Intellectual Property
All content within Ponoki, including the companion character designs, logos, artwork, software code, soundscapes, and writing, is the exclusive intellectual property of Concept Allies and Yogesh Jain. You are granted a limited, non-exclusive, non-transferable, personal license to use the application for your own non-commercial personal wellness. You may not copy, reverse engineer, distribute, or resell any part of the application or brand assets without explicit written permission.
4. Pro Pass & Digital Purchases (Gumroad & Google Play)
Ponoki provides a free core suite of 10 therapeutic focus activities with zero paywalls or advertisements. We also offer an optional Lifetime Pro Pass ($4.99 USD one-time purchase) available via Gumroad or Google Play In-App Billing:
- Lifetime Access: A Pro Pass purchase unlocks custom companion color skins, bonus Zen audio mixer slots, and future Pro enhancements across supported platforms.
- Payment Processing: Transactions are processed by Gumroad, Inc. for web purchases or Google LLC for Android Play Store purchases.
- Refunds: Refund requests are governed by the merchant policies of Gumroad or the Google Play Store. Please contact support if you experience any technical trouble verifying your purchase license.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Concept Allies and Yogesh Jain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the application. The service is provided on an "as is" and "as available" basis.
